Federal Court Rejects Challenge to Oregon’s Health Care Transaction Review Law

This article examines the litigation on Oregon HB 2362, which was contested by the Oregon Association of Hospitals and Health Systems in federal district court in Oregon. The OAHHS argued the law was unconstitutionally vague and delegates too much authority to the Oregon Health Authority. The federal district court dismissed the vagueness claims, and declined to rule on the nondelegation claim, pushing that claim back to the state court. The case is on appeal.
